Terms of Use
These terms apply to the mTrip mobile apps, the mTrip cloud platform and the mtrip.com website. Please read them before you use any of them.

1. About these terms
These Terms of Use (the “Terms”) form an agreement between you and mTrip Inc. (“mTrip”, “we”, “us”), a company based at 4388 Rue Saint-Denis, Suite 200, Montreal, Quebec H2J 2L1, Canada.
The Terms cover the following (together, the “Services”):
- Mobile apps: the iOS and Android apps built on mTrip technology, including the TripAgent app and apps published under the name and brand of a travel company, as well as the web itinerary that accompanies them.
- Cloud platform: the mTrip web platform, including the itinerary builder, document delivery, traveler communication, risk management tools and the related APIs and integrations.
- Website: www.mtrip.com and its language versions.
By downloading, accessing or using any of the Services, you accept these Terms. If you do not accept them, do not use the Services.
2. Who these terms apply to
Travelers. If a travel agency, tour operator, travel management company or other travel company (your “Travel Company”) has shared a trip with you through an app or web itinerary, these Terms apply to your use of that app or itinerary. Your Travel Company provides your trip information and remains responsible for your travel arrangements.
Business customers. If you use the cloud platform on behalf of a company that has signed a subscription agreement with mTrip, that agreement governs your company’s use of the Services. These Terms also apply to you as an individual user. If these Terms conflict with your company’s agreement, the agreement prevails.
Website visitors. If you browse www.mtrip.com, these Terms apply to your use of the website.
3. Eligibility
To use the Services, you must have reached the age of majority where you live, or use them with the consent and supervision of a parent or legal guardian. A parent or guardian who lets a minor use the Services accepts these Terms on the minor’s behalf and is responsible for that use.
4. Accounts and access
Some parts of the Services require an account or an access code. You agree to:
- provide accurate information and keep it up to date;
- keep your login details confidential and not share your account;
- tell us promptly at [email protected] if you believe someone has used your account without permission.
You are responsible for activity under your account. Business customers are responsible for the users they invite to the cloud platform and for the access rights they give them.
5. Acceptable use
We grant you a limited, non-exclusive, non-transferable and revocable right to use the Services for their intended purpose. You agree not to:
- copy, modify, distribute, sell, rent or sublicense the Services or any part of them;
- decompile, reverse engineer or attempt to extract the source code of the apps, the platform or the website, except where the law expressly allows it;
- create derivative works, translations or modified versions of the Services;
- scrape, harvest or extract data from the Services by automated means without our written consent;
- probe, test or bypass the security of the Services, or interfere with their operation;
- upload viruses, malicious code or content that is unlawful, infringing, defamatory or harmful;
- use the Services to send unsolicited messages or to break any applicable law;
- use the Services in breach of applicable economic sanctions, export control laws or trade regulations.
We may suspend or restrict access if we reasonably believe you have broken these rules.
6. Trip information and travel documents
The Services make travel more convenient. They do not replace your official travel documents. You still need your passport, visas, tickets, boarding passes and any other documents your airline, carrier or destination requires.
Trip details come from your Travel Company and from third parties such as airlines, flight status providers, weather services and content sources. We take reasonable care to display this information accurately, but we cannot guarantee that it is complete, current or error free. Flight times, gates and schedules can change at short notice. Always check airport screens, announcements and your carrier’s official channels.
Safety, security and destination information, including alerts from the risk management tools, is provided for general guidance only. You remain responsible for staying informed and for your decision to travel. Neither mTrip nor any third-party provider is responsible for costs or losses that result from changing or cancelling a trip based on information shown in the Services.
7. Location features and notifications
Some features, such as maps, live location and traveler safety tools, use the location of your device. They only do so if you allow it in your device settings, and you can withdraw that permission at any time. Some features may then stop working.
Location features help you find your way and help your Travel Company support you. They are not a substitute for emergency services, official maps or professional navigation equipment, especially outdoors or in remote areas. Location data may be inaccurate or unavailable without a network or GPS signal. In an emergency, contact local emergency services first.
The apps may send push notifications about your trip, such as schedule changes, messages and alerts. You can turn them off in your device settings, but you may then miss important updates.
8. Internet connection and data charges
Some features of the apps need an internet connection, through Wi-Fi or your mobile network. We cannot guarantee full functionality without one.
Your agreement with your mobile network provider still applies when you use the apps. You are responsible for any data, roaming or other charges, including when you use the apps outside your home country with data roaming turned on. If you are not the bill payer for your device, we assume you have the bill payer’s permission to use the apps.
9. Updates, availability and termination
We improve the Services regularly. We may add, change or remove features, and the system requirements for iOS, Android and supported browsers may change. To keep using the apps, you may need to install updates. We do not promise that every version of the apps will work with every device or operating system version.
We aim to keep the Services available but do not guarantee uninterrupted access. Maintenance, updates or events outside our control may cause interruptions.
We may suspend or stop providing all or part of the Services at any time. Business customers will receive the notice set out in their subscription agreement. When your access ends, the rights granted to you under these Terms end, and you must stop using the Services and delete the apps from your devices if we ask you to.
10. Content you submit
You keep ownership of the content you upload, submit or create through the Services, such as itineraries, documents, photos, messages and comments.
You grant mTrip, and the service providers acting on our behalf, a worldwide, royalty-free, non-exclusive license to host, store, copy, process, transmit, display, adapt and translate that content, only as needed to operate, secure and improve the Services and to deliver them to the people you choose to share with.
You confirm that you have the rights needed to submit the content and that it does not break any law or infringe anyone’s rights. For business customers, the handling of customer data is also governed by the subscription agreement and any data processing agreement in place.
If you send us ideas, suggestions or other feedback about the Services, we may use it freely to improve our products, without any obligation to you.
11. Privacy
Our Privacy Policy explains how we collect, use and protect personal information. When a Travel Company shares a trip with you, that company also processes your personal information under its own privacy policy.
12. Intellectual property
The Services and their content, including software, source code, design, text, graphics, images and databases, are protected by copyright, trademark and other intellectual property laws. They belong to mTrip, its licensors or the Travel Companies whose names and brands appear in the apps. These Terms do not transfer any ownership to you.
You may view, download and print pages of the website for your own personal, non-commercial use. Any other copying, reproduction, distribution or storage requires the prior written consent of the rights holder.
13. Third-party content, links and services
The Services may include content, links, offers or features provided by third parties, such as maps, flight information, weather, destination guides and websites of airlines, hotels or other suppliers. We do not control these third parties and are not responsible for their content, products, services or privacy practices. You use them at your own risk and under their own terms.
14. App Store and Google Play
The apps are distributed through the Apple App Store and Google Play, either by mTrip or by your Travel Company under its own name (the “App Provider”). If you downloaded an app from one of these stores, the following also applies:
- These Terms are between you and the App Provider, not Apple or Google. Apple and Google are not responsible for the app or its content.
- Your right to use the app is limited to devices that you own or control, as permitted by the usage rules of the store you downloaded it from.
- Apple and Google have no obligation to provide maintenance or support for the app.
- If the app fails to meet an applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app, if any. To the extent permitted by law, Apple has no other warranty obligation for the app.
- Apple and Google are not responsible for any claims relating to the app, including product liability claims, claims that the app fails to meet legal or regulatory requirements, consumer protection or privacy claims, or claims that the app infringes third-party intellectual property rights.
- You confirm that you are not located in a country subject to a U.S. government embargo or designated as a “terrorist supporting” country, and that you are not on any U.S. government list of prohibited or restricted parties.
- You must comply with any applicable third-party terms, such as your mobile carrier’s terms, when using the app.
- Apple, Google and their subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
If these Terms conflict with the terms of the store you downloaded the app from, the store’s terms prevail to the extent of the conflict.
15. Disclaimer of warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTY OR CONDITION OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTY OR CONDITION OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT.
MTRIP AND ITS THIRD-PARTY PROVIDERS DO NOT WARRANT THAT THE SERVICES, OR THE SERVERS THAT SUPPORT THEM, WILL BE UNINTERRUPTED, ERROR FREE OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
16. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, MTRIP, ITS AFFILIATES AND ITS THIRD-PARTY PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY OR CONSEQUENTIAL DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, BUSINESS, GOODWILL OR DATA, ARISING FROM OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SERVICES OR ANY INFORMATION OR WEBSITE LINKED FROM THEM, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
For business customers, the liability terms of the subscription agreement apply in place of this section. Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, for gross negligence or intentional misconduct, or for any other liability that cannot be excluded or limited by law. Nothing in these Terms limits rights that you have under consumer protection laws that cannot be excluded by contract.
17. Events outside our control
We are not responsible for any failure or delay in providing the Services caused by events beyond our reasonable control, such as natural disasters, pandemics, war, terrorism, strikes, government actions, failures of the internet or of telecommunications, power or hosting providers, or failures of third-party data sources such as airlines and flight information providers.
18. Indemnity
To the extent permitted by law, you agree to indemnify and hold harmless mTrip, its affiliates, employees, agents, representatives and third-party service providers from any claims, liabilities and costs, including reasonable legal fees, arising from content you submit, your unauthorized use of material obtained through the Services, or your breach of these Terms.
19. Copyright complaints
We respect intellectual property rights and respond to notices of alleged copyright infringement in line with the U.S. Digital Millennium Copyright Act of 1998 and other applicable laws. If you own a copyright, or are authorized to act for the owner, and believe material in the Services infringes it, send a notice to our Copyright Agent that includes:
- identification of the copyrighted work, or a representative list if the notice covers several works;
- identification of the material you claim is infringing, with enough detail for us to locate it, such as a URL or a screenshot of the app screen where it appears;
- your mailing address, telephone number and email address;
- this statement: “I have a good faith belief that the disputed use of the copyrighted material is not authorized by the copyright owner, its agent or the law”;
- this statement: “The information in this notice is accurate and, under penalty of perjury, I am the owner, or authorized to act on behalf of the owner, of the copyright or of an exclusive right under the copyright that is allegedly infringed”;
- your full legal name and your physical or electronic signature.

20. Changes to these terms
We may update these Terms from time to time. We will post the new version on this page and change the “Last updated” date above. If a change is significant, we will take reasonable steps to let you know. By continuing to use the Services after an update, you accept the revised Terms.
21. Governing law
These Terms are governed by the laws of the Province of Quebec and the federal laws of Canada that apply there. The courts of the judicial district of Montreal, Quebec, have exclusive jurisdiction over any dispute relating to these Terms or the Services, unless the mandatory law of your country of residence gives you the right to bring proceedings elsewhere.
22. General provisions
- Entire agreement. These Terms, together with our Privacy Policy and, for business customers, the subscription agreement, form the entire agreement between you and mTrip about the Services.
- Severability. If a court finds any part of these Terms invalid or unenforceable, that part will be limited or removed to the minimum extent necessary, and the rest of the Terms will remain in effect.
- No waiver. If we do not enforce a provision of these Terms, we do not give up our right to enforce it later.
- Assignment. You may not transfer your rights under these Terms without our written consent. We may transfer our rights to an affiliate or to a successor in a merger, acquisition or sale of assets.
